Truehome’s Privacy Policy

This statement discloses the privacy practices for the Truehome® website, which may be accessed through www.truehome.net or through other related domains  (collectively referred to as “Truehome”). Truehome® is the trademark of the Nidiant™ Corporation, a Texas corporation with offices at 302 North Live Oak in Round Top, Texas 78954, which wholly owns Truehome.net. The purpose of this statement is to let you know what personally identifiable information of yours will be collected by the Truehome® site, how it will be used, and what options are available to you regarding the collection, correction and/or deletion of information.

Privacy options differ for consumer users and professional users. Details for each user group are discussed in the appropriate section below.

Nidiant™ Corporation is a licensee of the RapidSSL Web Privacy Seal Program. RapidSSL is an independent, non-profit organization whose mission is to build users' trust and confidence in the Internet by promoting the use of fair information practices. This privacy policy covers the website www.truehome.net. Because this website wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance by RapidSSL.

If you have questions or concerns regarding this policy, you should first contact Chris Travis, Chief Executive Officer of Nidiant™ Corporation, at customer support. If you do not receive acknowledgement of your inquiry or your inquiry has not been satisfactorily addressed, you should contact RapidSSL Customer Support. RapidSSL will then serve as a liaison with Nidiant™/Truehome® to resolve your concerns.

The Data and Information We Collect and How It’s Used

1. Questionnaires and Reports

Truehome® collects a wide variety of information which is used to inform our customers about their relationship with their home and with those professionals who might help them implement a home-related project or other project. Except as explicitly provided herein, none of the specific information collected by Nidiant™ Corporation through Truehome.net as part of any exercise or personality profile is made accessible to the public, other users of the site or anyone not employed by Nidiant™ Corporation directly.

This information— including, for example, a user’s name, address, email, type of professional practice and license numbers of Truehome® professional users, and credit card information of professionals who have purchased auto-renewing subscriptions or pay-per-click ads—is kept strictly confidential and can be deleted at the user's request by contacting us at customer support. Information collected during the registration process for consumers which may be shared with other users or with third parties will be displayed in a strictly anonymous manner with no personally-identifying details unless otherwise requested by that user. Information collected during the registration process for professionals which may be shared with other users or with third parties will include such personally-identifying details as full name,  city, state, country, zip or postal code, and profession. Non-subscribing visitors to Truehome® are not allowed access to any personally-specific details of this information in any way.

By registering as either a consumer user or a professional user, and by using any services and aspects of Truehome®, you agree to allow the Company to anonymously use the information about your experiences with Truehome® to continue the Company's research into environmental psychology, residential architecture, and systems processes and to improve Truehome®. This research, conducted by psychologists, psychometricians, and behavior research scientists, may be published in academic journals. However, all of your responses will be kept anonymous and no personal identifying information will ever be published. We may make available additional information about such research on Truehome.net.

Nidiant™ Corporation also reserves the right to sell and market statistical information developed via Truehome® products relating to buying trends and consumer preferences and other useful information to third parties based on the collective responses of all persons who use its products. However, this information will only be shared as statistical information and will not include any specific or personally identifiable information about individuals or families.

2. Information Supplied By You at Registration

When you sign up to become a consumer user at Truehome®, you provide a non-identifiable user name, email, zip or postal code, and a password. Professional users provide their full name, email, city, state, country, zip or postal code, password, and their profession. We offer opportunities for users to provide additional information, including profile picture, phone number, Skype ID, Facebook URL, etc. to help connect with other users. For more information on the privacy of additional profile information, see Section 3: Your Profile Information.

Email contact information provided by users is also used, based solely on their requests or stated preferences, to notify them of potential matches with other users (e.g., consumers matched with appropriate professionals and other compatibility matches as requested) identified by Truehome®. Permission to contact users via email is controlled in the Notification Settings section in the Settings tab of the user’s Profile page.

In addition, if a consumer registers on the website using a promotion code given to him or her by a Truehome® professional, that professional will receive an email notification that the consumer has registered. This email to the professional will also provide the professional with certain registration information supplied by the consumer at registration.

You may not opt-out of receiving communications related to your use of a promotional code provided by Truehome® a Truehome professional.

Once you begin Truehome®'s registration process, we may also occasionally email you newsletters and notifications of special events or product offerings at Truehome.net. If you have started, but not completed, the registration process, we may also send you email messages encouraging you to complete the process and become a subscriber. All of the email messages we send you may contain code that enables our database to track your usage of the emails, including whether the email was opened and/or what links (if any) were clicked. If you would rather not receive emails about special events, new products, promotions or other noteworthy news, please see the section below labeled "Choose to Opt Out". Nidiant™ Corporation fully complies with the requirements of the federal CAN-SPAM Act.

In addition to the above-mentioned emails, Truehome® may communicate with you concerning features or functions of our services through notices on our website. You may opt out of receiving information about new products and features on Truehome by checking the appropriate box in the Notification Settings section in the Settings tab of the user’s Profile page.

3. Your Profile and Contact Information

Consumer Profiles

Consumer profiles are divided into three sections: Public, Private, and Settings. Any information entered into the Public section is accessible by all members of the Truehome® network. Access to a user’s Private profile, which contains user’s contact information, is controlled entirely by the user in the Privacy Settings section of the Settings tab on the Profile page. The Settings tab cannot be accessed by anyone other than the user and authorized truehome support staff. User controls access to their Private tab and can restrict access to Approved Pros, Invited Pros, Collaborators of Approved Pros, Friends, or any combination thereof. By checking none of these boxes, user is restricting access to everyone. User is advised to bear in mind when adjusting access to the Private tab that, if invited Pros are denied access to the user’s contact information in the private tab, they will not be able to communicate with the user except via the group chat feature of projects to which they have been invited.

Professional Profiles

Professional profiles are divided into five sections: Portfolio, Public, About Me, Company, and Settings. Any information entered into the Public, About Me and Company tabs is accessible by all members of the Truehome network.  Additionally, any information entered into the Public tab is open to Google searches. The Settings tab cannot be accessed by anyone other than the professional user and authorized truehome support staff. Professionals can choose not to divulge information they wish to be kept private on the Public, About Me, or Company tabs but they cannot make the tab private. Professionals are advised to bear in mind that consumers will be unable to contact them except through the Truehome® network  if they choose not to display additional contact information.

Search for Friends

In order to maximize your connections with other users, Truehome® allows consumer users to search for other consumer users to invite as friends by DiscoverHome quizzes taken, user name, email address, city, state, country, and/or zip or postal code. Users may not opt out of this search but can decline any invitations they receive. Search results allow the searcher to visit the public profile and view the slideshow of any consumer users found in the search results and to send them an invitation. Searchers may also view any Notebook pages and Projects that are unlocked (i.e. open to the network) for any of the consumer users found in the search results. Privacy for Notebook pages and Projects are found on the Notebook page or Project and are controlled by their “owner.” For more information on these settings, see Section 4: Sharing.

Search for Professionals

Consumer users may also search for professional users by profession type, name, company name, email address, city, state, country, or zip or postal code. Search results for professionals allow the searcher to visit the public profile and view the portfolio of any professional users found in the search results and send them an invitation. Pros may not opt out of this search but can decline any invitations they receive. Consumers also have the ability to send email invitations to pros whose email address they possess.

Search for Consumers

Pros may not solicit otherwise unknown clients through Truehome®. Pros may send email invitations to consumers whose email address already in their possession. Pros may search for consumer users—identified only by their user name—by DiscoverHome quizzes taken, by date signed up, by email address or city, state, or zip code in order to send them BuildBoard advertisements relevant to their area of interest. Consumer users who receive unsolicited BuildBoard ads through the Truehome® network can simply delete any that are unwanted. Consumer users may also report inappropriate content if necessary. Consumers who receive BuildBoard ads via email may opt out of receiving future BuildBoard ads from Truehome® by clicking “unsubscribe” on the BuildBoard email.

Search for Collaborators

Pro users may search for other professional users (aka Collaborators) by profession type, name, company name, email address, city, state, country, or zip or postal code. Search results for collaborators allow the searcher to visit the public profile and view the portfolio of any professional users found in the search results and send them an invitation to collaborate. Pros may not opt out of this search but can decline any invitations they receive.

Demographic and profile data is also collected at our site. We use this data to tailor our visitors’ experience at our site in order to recommend content that we think they might be interested in, displaying the content according to their preferences. Some of this information (i.e., customer demographic information) may be shared with advertisers upon their request or others on an aggregate, non-personally-identifiable basis. Truehome® will not contact advertisers on your behalf.

Any testimonials you wish to share with Truehome® will not be posted without your express permission and will be posted anonymously if requested.

As we develop our business, we may buy or sell assets and, depending on the transaction, your personally identifiable information may be one of the transferred assets. In the event that we are acquired by another company, your personal information may be part of the assets transferred to the acquiring party.

4. Sharing Information

Invitations

In order to connect with other users and professionals, you may send invitations either to their Truehome® profiles or to their email addresses, if they are not Truehome® users or if you cannot find them in the Truehome® network. You have the option not to invite anyone you do not trust or accept invitations from anyone you do not know. Friend/client/collaborator requests contain links allowing you to view the portfolio and public profile of the person who invited you, including all public Projects and Notebook pages.
Truehome® encourages its users to refer friends or service professionals to our website or to Truehome® professionals. You may share your DiscoverHome quiz results or refer a friend to our website. If you do, we will ask for your friend’s name and email address in order to contact them. We will store this information in our database for the purpose of sending a one-time email to your friend, indicating that you wish to share your results and/or invite your friend to visit our site. We ask that you not inconvenience Nidiant™ Corporation, or any other individuals or entities, by giving us names and email addresses of those who would not likely be interested in Truehome®.

Truehome® provides search services to help users find information and learn more about Truehome®  professionals. We use public information gathered during the registration process to impart information for our search feature, including name, city, state, country, zip or postal code, and profession.

Insight Stream

DiscoverHome Quiz results, known as Insights, automatically become part of a public stream of Insights much like a Twitter feed, unless a user locks the notebook page with which that Insight is associated. (All Insights are associated with a Notebook page.) By default, a user’s Truehome® Notebook pages are unlocked and open to anyone in the network. Insights contain links to consumer users’ profile via their user names or to professional users’ ProFile via their first and last name and to the Notebook page associated with that Insight, unless that Notebook page is locked.

Privacy options for individual Notebook pages are found on the Notebook itself and include locked (excluding everyone), unlocked (open to everyone), or friends and pros only (viewable only by friends and pros in that user’s Truehome® network). Users have the option to override Notebook page privacy settings for individuals under the Special Permissions section of the Settings tab in their profile simply by selecting the name of the friend or pro/client or collaborator and changing the lock/unlock icon accordingly.
User-created Insights have an additional privacy setting exclusive to that Insight, under the Edit options available by clicking the blue arrow on the Insight. This allows a user to make public an Insight for an otherwise locked Notebook page or make an Insight associated with an unlocked Notebook page private or available only to friends and pros or clients and collaborators in their network. Insights set to “private” do not appear in the Insight stream under any circumstances. They can, however, be shared via the “Share with Friends/Professionals” link on the Insight.

Projects

Truehome® users have the ability to create projects which can be shared with other members of the Truehome® network by invitation. Each project has an associated ToolKit with privacy setting options.  Privacy setting options are “Everyone in My Network,” or “Only Project Members.” Projects set to allow access to project members only can only be viewed by users who have received and accepted an invitation to join that project. Projects set to “Everyone in My Network” can only be viewed by friends and pros or clients and collaborators in that user’s Truehome® network, as well as pros to whom the user has sent an invitation to join their network.
You may choose to share information with professionals that are not associated with Truehome® through on-site opportunities. This contact is at your discretion and we will not provide your information to these professional users without your consent.

5. Information Supplied By You at Purchase

Nidiant™ Corporation offers, for retail sale, products to users seeking to understand their relationship with their home, as well as products related to successful home-related relationships and environmental and psychological personal growth. Nidiant™ Corporation also offers products and services to professionals who assist their clients with such matters. To process paid subscriptions, referral fees, and/or product purchases, we will require users to provide their first and last name, billing address, phone number, email address, and credit card information. Information gathered during product purchases is used primarily to process orders or as otherwise described herein. In general, someone who purchases a product at Truehome.net will receive one email notification that they have placed an order, and another email notification that their order has been filled. They will be similarly notified of subscription renewal transactions when they occur.

Credit card transactions are processed through industry standard secure socket layer encryption by a third party, which only uses your information for that purpose.

We will only share your information with third parties in the ways defined in this privacy policy.

6. Information Supplied By Your Browser

Truehome®  logs IP addresses for systems administration purposes. IP addresses are logged to track a user's session. This gives Nidiant™ Corporation an idea of which parts of our site users are visiting. We do not link IP addresses to anything personally identifiable. This means that a user's session will be tracked, but the user will be anonymous.

Truehome® also receives information about your computer operating system, your browser type, location, email patterns, mobile device operating system, and the name of your ISP or mobile carrier. Truehome® analyzes these trends in order to improve service to you.

Our site may use “cookies” to keep track of some types of information while you are visiting or using Truehome®. Cookies are very small files placed on your computer, so that when you return to the Truehome® website we can identify you. Cookies are needed for the Truehome® site to operate properly. If your browser is set to reject all cookies, the site may not function properly.

7. Third-Party Advertising

Advertisements, promotions, and offers from third-party advertisers may be provided to you while you are visiting the Truehome® website and/or when you purchase Truehome® products.  Truehome® may provide your contact information to the advertiser, sometimes by pre-populating their offer registration forms, but only if you choose to accept any such offers and authorize such release. Your information will not be transferred until you actually accept their offer. You will be submitting your information directly to the third-party advertiser. You may opt out of their offer at any time up until this point. Please refer to the third-party advertiser’s own privacy policy if you have any questions regarding how they use your information. Truehome® does not intend to endorse or in any other way make judgments about these third-party advertiser offers, promotions, products and advertisements.

We may use third-party advertising agencies or third-party advertisers (e.g., retailers of goods or services) to serve ads on behalf of Nidiant™ Corporation and Truehome®.  By doing so, Truehome® does not intend to endorse or in any way make judgments about these third-party advertiser offers, promotions, products and advertisements. These companies may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous. We have no access or control over these third-party cookies.

8. Legal Disclaimer

Though we make every effort to preserve user privacy, we may disclose information you provide if required to do so by law or if we have a good faith belief that disclosure is necessary to (1) comply with the law or with legal process served on us; (2) protect and defend our rights or property; (3) act in an emergency to protect someone's safety; or (4) as expressly provided herein.

9. Personal Responsibility of Users

Truehome is a social network that is open to any user who signs up and fulfills our Terms of Use documents. Truehome users author their own Insights, comments, chat conversations and otherwise interact within the network without any direct control of Nidiant Corporation, aka Truehome. Users must assume all legal and personal responsibility for their own content, comments, postings, conversations and other actions on the website and be responsible for maintaining their preferred level of privacy. Users are responsible for protecting the intellectual property of others. Websites, videos, blog post, images and other content posted by users are their own responsibility under law. Users must also acknowledge that in a social network setting, other users may post inappropriate or offensive content, may interact in inappropriate or offensive ways, or otherwise seek to harm or harass others. Please report such behavior as Truehome – but in the end you must manage the relationships you establish and maintain on the Truehome.net website.

10. Age Restrictions

Truehome® restricts use of its service to persons 13 years of age and older and will not knowingly or intentionally refer anyone under the age of 13 to a Truehome® professional. All adults are welcome to explore the site, utilize our free trial, and buy our products. As per the Children's Online Privacy Protection Act, any information we receive from people we reasonably believe to be minors will be purged from our database.

11. Security

Nidiant™ Corporation has extensive security measures in place to protect the loss, misuse, and alteration of the information stored in the Truehome® database. These measures include the use of SSL encryption (security standard secure data encryption technology using 128-bit Secure Sockets Layer) during credit card transactions and administrative access to site data, as well as other proprietary security measures which are applied to all repositories and transfers of user information. Although we will exercise reasonable care in providing secure transmission of information between your computer and our servers, we cannot ensure or warrant the security of any information transmitted to us over the Internet and we accept no liability for any unintentional disclosure.

Your privacy is important to us at Truehome®, so we provide you several options to control your privacy. However, please be aware that no security measures are perfect. We have no control over the actions of other users with whom you share your information, whether only authorized persons will view your information, or whether information you share on Truehome will not become public. There is no guarantee against a breach of Truehome® security measures.  Reduce your risks by using common sense practices such as selecting a strong password and using updated antivirus software.

Policies and Remedies

1. Links to Other Sites

Nidiant Corporation is not responsible for the privacy practices or the content of other websites that may be linked to this site or of any third-party advertisers.

2. Choose to Opt Out

Truehome® users may use the following options for removing their information from our database if they do not wish to receive future communications.

  1. 1. Send email to customer support with the word "Remove" in the subject field.
  2. 2. Follow the unsubscribe instructions included in each email (other than those sent for customer service purposes).

3. Correct/Update

Nidiant Corporation provides users the following options for changing and modifying information previously submitted:

  1. You may change your credit card, password and other information by going to your My Account area at the Truehome.net website. (NOTE: credit card information is stored only for professional users who have opted-in to subscriptions or Truehome’s pay-per-click advertising platform.)
  2. You can send an email to customer support.

4. Memorializing Accounts

If we learn that a User is deceased, we may memorialize the User’s account. In these cases we may restrict profile access, remove messaging functionality, and close an account if we receive a formal request from the User’s next of kin or other proper legal request to do so.

If we are notified that a user is deceased, we may memorialize the user’s account. In such cases we restrict profile access to confirmed friends, and allow friends and family to write on the user’s Wall in remembrance. We may close an account if we receive a formal request from the user’s next of kin or other proper legal request to do so.

6. Acceptance of Privacy Policy

Your use of our website, including any dispute concerning privacy, is subject to this privacy policy and the Terms and Conditions of Service. BY USING OUR WEBSITE, YOU ARE ACCEPTING THE PRACTICES SET OUT IN THIS PRIVACY POLICY AND OUR TERMS AND CONDITIONS OF SERVICE.

If we change this privacy policy, we will post those changes to this privacy policy page and any other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
